An engagement exists only under a written engagement agreement signed by us and the client, and, where required, approved by the bankruptcy court. Any such agreement, and any court order, governs that engagement and prevails over these terms.

No guarantee of outcomes

We do not guarantee any outcome, including whether data can be sold, whether a court will approve a retention or sale, the timing of any process, or any sale price or recovery. References to past or third-party transactions are for context only and do not predict results in any other matter.

Information you submit

Do not send privileged, confidential or proprietary material, documents, or personal information about individuals through the request form or by unsolicited email. Until an engagement and any confidentiality agreement are signed, submitting information does not create a duty of confidentiality or prevent us from acting for others, except as the law requires.

By submitting information, you represent and warrant that you have the right and authority to share it, and that sharing it does not violate any law, court order, privilege, confidentiality obligation or third-party right. You confirm: "White Knight Restructuring may contact me about this request." We handle what you submit as described in our Privacy Policy.

Acceptable use

You agree not to:

• Use the website in violation of any law or for any fraudulent or harmful purpose.
• Submit false or misleading information, or impersonate any person or organization.

Governing law and venue

You agree to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida. This does not limit the jurisdiction of a bankruptcy court over any matter in which we are engaged. To the extent permitted by law, any claim must be brought individually and not as part of a class or representative action, and each party waives trial by jury.

Severability and other terms

If any provision of these terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will stay in full effect. Our failure to enforce a provision is not a waiver. These terms and our Privacy Policy are the entire agreement between you and us about the website; a signed engagement agreement governs any engagement. You may not assign these terms; we may assign them.

Changes to these terms

We may change these terms at any time by posting the updated version on this page with a new effective date. Your continued use of the website after a change means you accept the updated terms.
